Dependency staus

I ut in a claim for dependency when I received my initial AB8 in Spetember because for whatever reason my son did not get counted as a dependent even though all his info was on the original claim.  The strange thing is that the messages in ebennies related to the claim status keep changing currently it says:

Timeline for large retro from appeal non-retiree

Hey all,

I did a search, but haven't found a good answer. Does anyone know a general timeline for the VARO to process an increase ordered by the BVA and issue a retro payment (in excess of 25K)? My appeal going back to 2007 was granted finally.

The decision was granted mid-October, and my VARO is Houston, and I am not a retiree.

Thanks,

Doug

Received TDIU and 5 digit retro. It took less than 90 days to complete after it was deffered by the VA. Of course had to wait almost 2 yrs. for the original claim to settle, but it is over now. Got to break the habit now of checking, calling, wondering and worrying. Have a blessed day my brothers and sisters, hope yours turns out as well. Thank you for your service and sacrifices.

Claim finally finished!

Well, I am also one of the many stalkers on this page that reads a lot but doesnt post very often.  I just wanted to say thank you for all the information you all supply to everyone to help us!  I finally won my fight with the VA.  I filed  a claim for increase April 2011.  I was with the VA in Chicago at the time.  They moved my claim to Roanoke in Aug 2011 and closed it in October 2011 with a denial.  I filed a CUE in Nov 2011 as per the recommendation of "Peggy".  I felt that I had made a huge mistake after reading a lot here but it payed out in the end.    I sat at claim received until Sept 2012.  I called "Peggy" who asked for an update since nothing had been touched in almost a year.  Within two weeks of "Peggy" inquiring about it, I started flying through all the stages and hit pending descision approval on Oct 20......to pending notification on 22 Oct....and completed on 27...

Claim finished in less than 5 months.

My AB8 letter showed up on eBenefits giving me 50%.  I retired 1 June and had my claim and C&P turned in back in Feb.  Nothing happened until 1 Oct and everything went through during the month.  My claim was in Salt Lake City.  From all that I have read that was my one shot at getting things done in a timely manner.  If I apply for an increase or anything else I'll be waiting years.

St. Petersburg and Movement to Preparation for Decision Phase

Afraid to think positive when it comes to eBenefits and the 1-800 number.
Claim for increase submitted to St. Petersburg July 14 2011.
C&P's completed in August 2011

About November 2011 was moved to Review Of Evidence per eBenefits.
Beginning of October 2012 moved back to Gathering of Evidence per eBenefits.
eBenefits now shows I am in Preparation for Decision Phase effective Oct 25, 2012 with an estimated completed date of: 01/24/2013 to 05/30/2013.  Actually seeing October 25, 2012 in there as an effective date of movement surprised me.

Called 1-800 number just to see what they would say, and was told I just moved to the Decision Phase.

Ebenefits AB8

I currently receive 50% compensation. I reopened my claim for herniated disc and sciatica in November 2011. The VA has it listed as lumbar strain and sciatica. I filed an appeal immediately after denied and the C&P examiner put that it probably occurred in 2001 during my pregnancy, which my records show has never happened prior to me turning 25 in training for deployment. unfortunately, the VA said they never received the claim and that is why I had to reopen my claim. I checked ebenefits, which I hadn't checked in 6 months and notice that I had a AB8 that states 40% effective date Dec 2011. This has me worried because my original claim for other items that were approved was for a total of 50%. I am worried that my original claim was decreased and my reopened claim was denied. I wouldn't mind if I receive 0% for my back, as long as it's service connected. When a claim is reopened, will the effective date only include the date for the reopened claim? I hope that I have explained...

Does anyone here have a Dependent Claim pending @ Winston-Salem?

Only Dependent Claims

If so, would you mind sharing the claim date for comparison?  Maybe some of us can get an idea when we might see resolution from that office.  They say "order recieved"  I'm wondering?

I have one pending - claim date Oct 11, 2011

Learned something new on Ebenefits

Since September my claim has been in the "prep for decision phase". If you open up your claims information on ebenefits its will say something like "Your claim is in the development phase, the duration of this phase will be determined by factors such as type of claim, etc. Well today I was checking Ebenefits and at first glance nothing has changed, still in Prep for Decision phase, but something did change. Now when I open up my claims for the details is says "Your claim is now in the Decision phase, the duration will be, etc......So there are actually two phases to the Prep for decision phase. The development phase, which I assume they are still gathering up information, and then once that is done it moves to the actual Decision phase. A little deceiving in a way when you consider at first glance nothing appears to have changed until you read the details of your claim. Anyway, given that is has been in the prep for decision phase(development) since 9/10/12, I HOPE now that its in...

Is two months normal

I would probably wait a couple days seeing as half the call centers are closed to the hurricane.

What is the difference between a retro claim and a BDD?

0
0
One, if not the main argument given for the reason that BDD/Quick Start claims are processed so quickly (relative to a regular claim) is that these types of claims are already fully developed. In other words by the time these claims hit the VA system all the work ie. documentation, C&P exams etc are already completed. Now is not a retro claim already a fully developed claim? There is no need for any more documentation, no need for any more evidence or exams. Why are not retro claims given the same handling as BDD claim?

Estimated Completion Dates

Does anyone have any personal experience or comments concerning Estimated Completion Dates for claims in E-Benefits?  Are they accurate, in-accurate, for show, constantly changing or what?

HooAhh

Confused. Rating phase? Additional info?

Change of Status: We determined that your claim needed additional review. If additional evidence is needed from you, you will receive a letter from us explaining what is needed.

Next Steps:

Your claim is currently located in our "Rating" phase. We will propose a decision on your claim when all outstanding requirements are satisfied.

Literally, 2 hours ago it was in the development phase (its been at preparation for decision since 8/10/12). So is the rating phase past the development phase? And why does it say now that the claim needs additional review? Has anyone had this happen before? The estimated completion date also got added 2 months to it (3/23/2013-9/3/2013). The claim opened on 8/31/2011. There were two separate C&P appointments as well. Maybe they are deciding on one contention?...

Good news

Finally got the BBE dated Oct 23, 2012 with 25 months of backpay. Thanks to all of you for the wisdom and support to put together a claim and persevere to a conclusion. When they finally got to my claim, the VA was excellent as was Ebenefits which updated very quickly. Mine might have been delayed because of personnel shortages and training new raters at the NYRO according to my State Vet Representative.

My timeline:

Sept 2010  filed for increase for Prostate Cancer (AO) radiation treatments,(they pay 100% temporary till 6 months  after treatment ends)

Sept 2011 received packet advising I could apply for TDIU

Oct  2011 C&P exam for TDIU, prostate cancer residuals for which I already was getting 40% from 2008 claim, and PTSD for which I was already getting 50% from 2008 claim (under appeal since 2010)

Nov 2011 obtained SSDI for service connected conditions only. They were great to deal with. Took 3...

What is a Rating Review ?

0
So after they closed my case in Lincoln, Nebraska on Friday, today a new claim shows up as a Rating Review under claim type, the original case is still at Pending Decision Approval.  Since I've been at 100% for the last 15 years for Diabetes Type 1, I'm wondering if this just the VAs way of crossing it's Ts and dotting it's Is, or maybe there is something more involved.  My AB8 still shows 100%,  I've checked the VBN board for Rating Review, but no one has brought this up, so I'll try.

WTH is going on?

My claim was moved from Roanoke to Washington DC. I'm confused because my claim just moved to Prep to Decision on September 25th so why would they move it Washington DC during the rating phase. Does anybody have any insight?

Nice surprise in my bank account this morning.
Paid off all my credit cards from medical bills, started a dental insurance plan and bought a new imac.
This really came at just the right time. I filed myself online almost two years ago without the help of a VSO.

I just want to thank everyone on this forum for listening to my whine and complain!!
My fight is not over! i will be appealing a few decisions made and start my journey all over, but this time i will have a little bit of breathing room.

Thanks again!!!
